ROCKERS ACADEMY, LLC

LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK 

ACCEPTANCE OF LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK. Please read this LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK (hereinafter, the "WAIVER") carefully before enrolling or otherwise participating in dance classes and activities offered by ROCKERS ACADEMY, LLC (Dynamic Rockers Academy Utah). This WAIVER governs your initial registration and/or use of the Services as well as any future registration and/or use of the Services. 

This WAIVER take effect when you click an 'I Accept (or similar) button or checkbox presented with this WAIVER or at the time of registering and/or using the Services. By accepting this WAIVER, you represent that you have lawful capacity to enter into contracts, e.g., you are not a minor, and that you are freely and voluntarily agreeing to be bound by this WAIVER. If you are agreeing to this WAIVER on behalf of a Student for whom you have legal responsibility, you represent that you have legal authority to act in the Student's behalf, and you consent and agree to this WAIVER on your behalf and on behalf of the Student. 

LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK. The Parent/Guardian and/or Student accepting this WAIVER (collectively, "Participant") agrees that participation in ROCKERS ACADEMY, LLC (Dynamic Rockers Academy Utah) classes, activities, and related events, and use of Dynamic Rockers Academy Utah facilities and equipment (collectively, the "Services") involves the ever-present risk of personal injury. Despite precautions and care taken by Rockers Academy, LLC and other participants, accidents and injuries will occur. 

PARTICIPANT HEREBY ASSUMES ALL RISK OF DAMAGE TO ITS PERSONAL PROPERTY AND INJURY TO PERSONS, IN, UPON, OR ABOUT ROCKERS ACADEMY, LLC PREMISES, OR HAVING BEEN SUSTAINED OR RESULTING FROM PARTICIPATION IN THE SERVICES, EXCEPT FOR DAMAGE OR INJURY CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF ROCKERS ACADEMY, LLC OR ITS AFFILIATES, AND PARTICIPANT HEREBY WAIVES ALL SUCH CLAIMS AND DAMAGES AGAINST ROCKERS ACADEMY, LLC AND ITS AFFILIATES. ROCKERS ACADEMY, LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY THEFT, LOSS, OR DAMAGE TO ANY OF PARTICIPANTS PERSONAL PROPERTY ENTRUSTED TO ROCKERS ACADEMY, LLC OR ITS AFFILIATES OR OTHERWISE BROUGHT ONTO ROCKERS ACADEMY, LLC PREMISES. 

“Affiliates" means, with respect to a specified person or entity, the respective owners, managers, employees, contractors, agents, and advisors or such person or entity. 

FITNESS TO PARTICIPATE. Participant acknowledges and represents that Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would prevent Participant from fully participating in the Services.
