TERMS AND CONDITIONS 

ACCEPTANCE OF TERMS. Please read these Terms carefully before enrolling in dance classes and activities offered by Rockers Academy, LLC (Dynamic Rockers Academy Utah) or before using //dynamicrockersut.com//. These Terms govern your initial registration and/or use of the Services as well as any future registration and/or use of the Services. 

These Terms take effect when you click on the accept button (or similar) button or checkbox presented with these Terms or when you register and/or use any of the Services or Website, whichever comes first. By accepting these Terms, you represent that you have lawful capacity to enter into contracts, e.g., you are not a minor. If you are agreeing to these terms on behalf of a Student for whom you have legal responsibility, you represent that you have legal authority to act on behalf of the Student, and you consent to and agree to these terms on your behalf and on behalf of the Student behalf, and you consent and agree to these Terms on your behalf and on behalf of the Student. 

RECITALS. ROCKERS ACADEMY, LLC (Dynamic Rockers Academy Utah) offers various dance classes and activities for boys and girls at its Lehi, Utah location. The Parent/Guardian and/or Student agreeing to these Terms (collectively, the "Participant") wishes to enroll in certain dance classes and activities of the type offered by ROCKERS ACADEMY, LLC.

PERMISSION TO PARTICIPATE. Participant agrees by enrolling Student in ROCKERS ACADEMY, LLC classes and activities and related events, Participant is granting permission for Student participate in physical activity on ROCKERS ACADEMY, LLC premises and at related outside events. Participant understand that in any physical activity, there is chance of an accident or injury. Participant further understand the nature of the activities in which Student will be participating. Student is in proper physical condition and capable of participating in the activities.

TUITION/CHARGES. Participant agrees to pay ROCKERS ACADEMY, LLC an initial registration fee of $35 per student or $50 per family due upon initial registration and/or use of the Services. Participant acknowledges that tuition and other fees are determined on an annual basis and are not pro-rated. Participant agrees that all registration, tuition, and fees are non-refundable and must be paid in full, or account must be current, for Student to attend class, participate in activities and related events, and the purchase of recital tickets. Participant also understand that tuition and fees is due the seventh day of the month. All tuition and fee payments made after the due date, will incur a $10 late fee. If tuition and fees are more than forty-five days late, Participant will not be permitted to participate in the Services. Participant agrees to pay ROCKERS ACADEMY, LLC a fee of $25 for all returned checks, ISF, Incorrectly Written, or other bank fees incurred as a result of a deficient payment. Participant responsible for storing a credit card on file and granting permission to ROCKERS ACADEMY, LLC to collect payments. Should Participant use another payment method, said payment will be recorded in the account and be credited to avoid the card on file being charged.

RECITAL/SHOW POLICY. Participant agrees that all school year Students must pay the recital/show Fee (includes costume & tights) for each dance for the recital/show and is non-refundable. Participant understands and agrees that there may be an additional charge for XL, XXL and adult size costumes. Participant agrees that Student may perform in more that one recital and recital dance. Participant agrees that everyone attending the recital must purchase a ticket for the show. 

DRESS CODE. The ROCKERS ACADEMY, LLC dress code is designed to instill discipline and uniformity. The Participant agrees that the Student must comply with the ROCKERS ACADEMY, LLC dress code. 

ATTENDANCE. Attendance and punctuality are important to Student's progress. Participant agrees that Student is enrolling in a dance program and must contact ROCKERS ACADEMY, LLC in the event of absences of two or more consecutive weeks. In the event the Student has more than three absences, he/she may not be allowed to participate in recitals, activities or related events.

CALENDAR. Participant agrees that the class calendar for the school year and important information, including class cancelations, is on the ROCKERS ACADEMY, LLC website. In the event of inclement weather and the possibly of classes canceled, Participant agrees to check the website for instructions. Participant also understand that ROCKERS ACADEMY, LLC is not required to schedule make-up classes due to an emergency cancelation. 

CANCELLATION POLICY. Written notice is required to cancel a class. In order to stop recurring monthly tuition charges, Participant must provide cancellation notice prior to the first calendar day of the month. Participant is responsible for tuition payments, account charges, late fees incurred through the last day of the month regardless of attendance.

HEALTH DISCLOSURE. Participant will notify ROCKERS ACADEMY, LLC if Student suffers from any medical or health condition that may cause injury to Student, or other participants, or that may require emergency care during Student's participation in ROCKERS ACADEMY, LLC classes, activities and related events, or use of ROCKERS ACADEMY, LLC equipment. 

RELEASE. Participant hereby waives liability, releases and assumes all risk related to Student's participation in ROCKERS ACADEMY, LLC classes, activities and related events in accordance with the terms and conditions of the Release, Waiver and Assumption of Risk accepted by Participant.

The Participant understands that in the event of an emergency (medical or otherwise), every effort will be made to contact the Parent, Guardian or Emergency contact. If either contact is unavailable, the Participant authorizes the medical provider to take the necessary steps to secure appropriate treatment to assist the Student, including outpatient and emergency medical care. 

AUTHORIZATION FOR PHOTOS AND VIDEOS. Without expectation of compensation, Participant grants ROCKERS ACADEMY, LLC and ROCKERS ACADEMY, LLC contracted photographer or videographer consent to use in perpetuity photos, videos and Student's likeness taken at class, activities and related events for educational and promotional purposes. 

PRIVACY. ROCKERS ACADEMY, LLC Privacy Policy can be viewed at //dynamicrockersut.com. ROCKERS ACADEMY, LLC reserves the right to modify its Privacy Policy in its sole discretion from time to time. 

ENROLLMENT DOCUMENTS. The terms and conditions of the ROCKERS ACADEMY, LLC Privacy Policy and the Disclaimer, Release and Assumption of Risk, together with all other documents and attachments delivered as part hereof or incident hereto (collectively, the Enrollment Documents) are incorporated as part of these Terms. These Terms, together with the Enrollment Documents, represent the entire agreement between ROCKERS ACADEMY, LLC and Participant. 

MODIFICATION OF TERMS. ROCKERS ACADEMY, LLC reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon the posting of any updated version of these Terms on the Website. The Participant is responsible for regularly reviewing these Terms. Continued use of the Services and/or the Website following such changes shall constitute the Participant's consent to such changes.
